By using the platform, you confirm that you meet this requirement and that you have authority to act for the business you register (e.g. gym or fitness center). 3. Services Provided Dhruvika Gymnesium Management Software Pvt. Ltd. provides GLOBAL GYM SOFTWARE, a cloud CRM for gyms and fitness businesses, including WhatsApp Cloud API features such as: WhatsApp inbox (send and receive messages) Message templates and campaigns Contact and group management Chat automation / bot replies (where enabled) Team members / agents (where your plan allows) Services may change or be updated without prior notice, within applicable law and your subscription terms. 4. User Responsibilities You agree to: Provide accurate information when registering and connecting WhatsApp or Meta accounts Use the platform in compliance with applicable laws, Meta / WhatsApp policies, and anti-spam rules Message only contacts you are allowed to contact (including marketing opt-in where required) Not use the platform for spam, harassment, fraud, or unauthorized access to others’ data You are responsible for your WhatsApp Business Account, tokens, and compliance with Meta’s terms. 5. Account Security You are responsible for keeping your login credentials and any API tokens or app secrets confidential. We are not liable for loss arising from unauthorized use of your account where you failed to protect credentials. 6. Payment and Refunds Fees depend on your selected plan (as shown on the website or in your agreement). You agree to pay applicable subscription or service fees WhatsApp messaging charges billed by Meta are separate from our fees Payments are non-refundable unless stated otherwise in writing or required by law 7. Intellectual Property All content on the platform (software, text, graphics, logos, and design) is owned by Dhruvika Gymnesium Management Software Pvt. Ltd. or its licensors. You may not copy, modify, or redistribute it without permission. 8. Privacy We handle personal data as described in our Privacy Policy (linked on the site). That includes data from Meta/WhatsApp when you connect WhatsApp to the CRM. 9. Limitation of Liability To the fullest extent permitted by law, GLOBAL GYM SOFTWARE is not liable for indirect, incidental, or consequential damages arising from use of the platform, including message delivery failures, Meta/WhatsApp outages, or third-party service issues. 10. Termination We may suspend or terminate access if you breach these Terms, abuse the service, or violate Meta/WhatsApp policies. You may stop using the service at any time; disconnect WhatsApp in Settings where applicable. 11. Governing Law These Terms are governed by the laws of India. Courts at Anand, Gujarat (or as applicable to your registered office) shall have jurisdiction, subject to mandatory consumer protections. 12. Changes to Terms We may update these Terms from time to time. The current version will be posted on https://smsnotification.gymsoftware.online/ (or the page we designate).
